How to Transfer Property as a Gift in Dubai (Step by Step)

  1. Step 1 — Confirm eligibility and relationship documentation: Establish the first-degree family relationship with the required documentation (marriage certificate, birth certificate, or equivalent). This is presented at the DLD and must be in Arabic or accompanied by a certified Arabic legal translation.
  2. Step 2 — Obtain NOC from the developer (if required):  For properties in strata developments, a No Objection Certificate from the developer or owners association is required, confirming no outstanding service charges. Standalone villas may not require a developer NOC.
  3. Step 3 — Obtain bank NOC (if property is mortgaged): If the property has an active mortgage, a written No Objection Certificate from the bank is required before the DLD will process the gift transfer. This confirms that there is no outstanding or new mortgage contract for the new owner.
  4. Step 4 — Book an appointment at Al Taresh Trustee Office: Both the donor and recipient (or their POA representatives) schedule an appointment at our Umm Suqeim 3 office. Our team will pre-verify all documents via WhatsApp before the appointment.
  5. Step 5 — Attend with all original documents: Both parties bring original IDs, relationship proof, title deed, and any NOC letters. Our team submits the gift transfer to the DLD system directly from our office.
  6. Step 6 — Pay the DLD gift transfer fee. The DLD fee of 0.125% of the property’s assessed value is paid at the trustee office, along with standard admin and title deed fees.
  7. Step 7 — Receive the new title deed Once the DLD approves the transfer, a new title deed is issued in the recipient’s name, typically within 1 working day.

Can a Mortgaged Property Be Gifted in Dubai?

Yes, a mortgaged property can be transferred as a gift in Dubai. However, the process requires an additional step: obtaining a written No Objection Certificate (NOC) from the mortgage lender (bank or financial institution). And the new mortgage contract under the new owner

The mortgage does not need to be cleared before the gift transfer, but the bank must formally consent to the change of ownership. After the gift transfer, the mortgage remains registered against the property. The recipient (new owner) assumes responsibility for the mortgage.
